Terms & Conditions

1. Acceptance of Terms

 

 

By accessing or using Encore (the “Service”), you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, do not use the Service.

 

Encore provides:

 

  • A tour management platform (macOS, iOS, and web)

  • Itinerary planning tools

  • Travel and show scheduling

  • Crew coordination features

  • Ticketing tools allowing organizers to sell tickets through Encore-hosted pages

 

 

These Terms apply to all users, including artists, managers, agencies, crew members, and ticketing organizers.

 

 

 

2. Eligibility

 

 

You must be at least 13 years old to use Encore.

Users under 13 are prohibited, and Encore will delete such accounts upon discovery.

 

 

 

3. Account Registration

 

 

To use Encore, you must create an account using a valid email address and accurate information.

 

  • Passwords are handled via Firebase Authentication; Encore never stores or sees your password.

  • You are responsible for maintaining the confidentiality of your account.

  • You must notify us immediately if you suspect unauthorized access.

 

 

Encore may suspend or terminate your account for violation of these Terms.

 

 

 

4. Subscription Plans & Payments

 

 

Encore offers free tiers, paid subscriptions, and optional in-app purchases.

 

  • Subscriptions may be purchased via Stripe or Apple In-App Purchases.

  • Pricing, renewal terms, and cancellation policies are communicated at the time of purchase.

  • Taxes may apply depending on your region.

  • Refunds are handled by Apple or Stripe depending on the payment method.

 

 

Encore does not store or process card details. All payment info is handled by third-party processors.

 

 

 

5. Ticketing Services

 

 

Encore allows event organizers (“Organizers”) to create events and sell tickets via Encore-hosted checkout pages.

 

 

Encore is not the event organizer.

 

 

Organizers are solely responsible for:

 

  • Event accuracy

  • Ticket availability

  • Pricing

  • Refund policies

  • Cancellations

  • Show changes

  • Communication with attendees

  • Ensuring tickets and events are legitimate and lawful

  • Handling disputes or chargebacks with buyers

 

 

Encore is not a party to the contract between organizer and ticket buyer.

 

 

Fraud, Misrepresentation, and Illegal Events

 

 

Encore reserves the right to:

 

  • Remove events

  • Disable ticket sales

  • Suspend or terminate Organizer accounts

  • Cooperate with law enforcement

 

 

Encore accepts no liability for fraudulent, misrepresented, or cancelled events.

 

 

 

6. Third-Party Data & API Disclaimers

 

 

Encore relies on multiple external APIs, including but not limited to:

 

  • FlightAware

  • Ableset (via embedded iframe)

  • Visa requirement checker

  • Airline, travel, and mapping data sources

 

 

 

Maximum Disclaimer

 

 

Encore is NOT a source of official travel, flight, visa, immigration, or logistical information.

All such information may be inaccurate, delayed, incomplete, or outdated.

 

Users must verify all travel, visa, and logistical details directly with:

 

  • Airlines

  • Embassies

  • Immigration authorities

  • Official government websites

  • Venue operators

 

 

Encore accepts zero liability for losses, delays, missed flights, denied visa entry, or any damages arising from reliance on third-party data.

 

 

 

7. User-Generated Content

 

 

Users may upload or input content such as:

 

  • Tour details

  • Crew information

  • Travel documents

  • Photos

  • Files

  • Notes

 

 

You grant Encore a non-exclusive, worldwide license to store, process, and display this content solely for the purpose of providing the Service.

 

You retain full ownership of your content.

 

You represent that:

 

  • You have the right to upload the content

  • The content does not infringe on any third-party rights

  • The content does not contain unlawful or harmful material

 

 

 

 

8. Offline Caching

 

 

Encore stores temporary data on users’ devices to enable offline mode.

 

Encore is not responsible for:

 

  • Data corruption

  • Offline sync delays

  • Conflicts between offline and online data

  • Data loss resulting from device failure or local storage issues

 

 

 

 

9. Intellectual Property

 

 

Encore, including its design, software, trademarks, branding, and all associated intellectual property, is owned by Encore Touring Limited.

 

Users may not:

 

  • Copy, modify, or reverse engineer the software

  • Create derivative works

  • Use the branding without permission

  • Resell or sublicense the software

 

 

 

 

10. Prohibited Conduct

 

 

Users must not:

 

  • Engage in fraudulent ticketing

  • Create deceptive or illegal events

  • Upload harmful or offensive content

  • Attempt to hack, disrupt, or misuse the platform

  • Violate third-party intellectual property rights

 

 

Encore may suspend accounts or remove content without notice.

 

 

 

11. Limitation of Liability

 

 

To the fullest extent permitted by law:

 

 

Encore’s total liability is capped at:

 

 

The amount the user paid for Encore subscription fees in the previous 12 months,

EXCLUDING any ticketing revenue, ticket fees, or amounts processed through ticket sales.

 

Encore is NOT liable for:

 

  • Event cancellations

  • Ticket disputes

  • Fraudulent events

  • Travel disruptions

  • Incorrect flight/visa information

  • Lost profits, lost data, or indirect damages

  • Third-party system failures (Stripe, Apple, Firebase, API providers)

 

 

Where liability cannot be excluded, it will be limited as above.

 

 

 

12. Indemnification

 

 

Users agree to indemnify and hold Encore harmless from claims arising from:

 

  • Event organization or ticket sales

  • User-generated content

  • Misuse of third-party data

  • Violations of these Terms

 

 

 

 

13. Data Retention & Privacy

 

 

Encore retains user data for up to 90 days after account deletion for operational, backup, and legal compliance purposes.

 

Anonymized analytics may be retained indefinitely.

14. Termination

 

 

Encore may suspend or terminate accounts for any violation of these Terms or misuse of the Service.

 

Users may request account deletion at any time.

 

 

 

15. Governing Law & Dispute Resolution

 

 

These Terms are governed by the laws of New Zealand.

 

 

Disputes must be resolved exclusively through online arbitration

,

 

 

except where arbitration is legally unenforceable.

 

Users waive the right to participate in class actions or court proceedings unless arbitration has failed.

 

 

 

16. Changes to Terms

 

 

Encore may update these Terms from time to time. Continued use of the Service constitutes acceptance of the updated Terms.
